3. Intellectual Property

3.1 Server Software (Homenichat-Serv)

The Homenichat-Serv server software is distributed under the GNU Affero General Public License v3.0 (AGPL-3.0). This license allows you to:

  • Use the software for personal or commercial purposes
  • Modify the source code
  • Distribute copies of the software
  • Distribute modified versions

Subject to compliance with the license conditions, including the obligation to publish the source code of any modified version you distribute or make accessible via a network.

3.2 Web Application (PWA)

The Homenichat-PWA progressive web application is distributed under the MIT license, a permissive license that allows free use, including commercial use.

3.3 Mobile Applications

The Homenichat mobile applications for Android and iOS are proprietary software. All rights reserved.

3.4 Trademarks and Logos

The name "Homenichat" and associated logo are protected trademarks. Any unauthorized reproduction or use is prohibited.

4. Personal Data and Privacy

4.1 Self-hosted Nature

Homenichat is self-hosted software. This means:

  • Your communication data (messages, calls, contacts) is stored only on your own server
  • We have no access to your personal data
  • No data is transmitted to our servers (unless you use our optional push notification service)

4.2 This Website

This promotional website:

  • Uses no tracking or analytics cookies
  • Collects no personal data
  • Does not use third-party analytics services

4.3 Push Notification Service (optional)

If you choose to use our push notification service:

  • Only device tokens necessary for sending notifications are transmitted
  • No message content is stored on our servers
  • Data is processed transiently only

4.4 Your Rights (GDPR)

Under the General Data Protection Regulation (GDPR), you have the following rights:

  • Right of access
  • Right to rectification
  • Right to erasure
  • Right to restriction of processing
  • Right to data portability
  • Right to object

Given the self-hosted nature of the software, these rights are exercised with the administrator of your own Homenichat installation.

5. Warnings and Disclaimers

5.1 WhatsApp Integration

Important: Homenichat offers two modes of connection to WhatsApp:

  • Meta Cloud API (official): Official Meta API, compliant with WhatsApp terms of service
  • Baileys (unofficial): Third-party library not affiliated with WhatsApp Inc. or Meta. Using this option may violate WhatsApp's Terms of Service and result in account suspension. You use this feature at your own risk.

5.2 Liability

The software is provided "as is", without warranty of any kind, express or implied. In no event shall the authors or copyright holders be liable for any damages arising from the use of the software.

5.3 Third-party Services

Homenichat may integrate with third-party services (Twilio, OVH, FreePBX, etc.). Use of these services is subject to their own terms of service and privacy policies.

Contributions to the project are welcome. By submitting a contribution (pull request), you agree to place it under the same license as the relevant project (AGPL-3.0 for the server, MIT for the PWA).
